Rodent Maintenance Program Terms

These terms govern the ongoing rodent maintenance services provided by Monster Wildlife Removal (the “Company”) and are incorporated by reference into the rodent maintenance service agreement signed by the client (the “Client”) for the property identified in that agreement (the “Property”). The version of this document in effect on the date the service agreement is signed is the version that applies. A printed copy is available at no charge upon request.

1. Service Description

Monster Wildlife provides ongoing rodent maintenance services for the Property. Services include:

  • Installation and maintenance of tamper-resistant rodent bait stations around the exterior perimeter of the Property
  • Regular inspection and replenishment of rodenticide bait as needed
  • Monthly or quarterly service visits, as selected in the service agreement
  • Documentation of all service activities
  • Assessment and recommendations for exclusion or habitat modification

2. Scope of Services

The Company will place tamper-resistant bait stations at strategic locations around the exterior perimeter of the Property. The number and placement of stations will be determined by the Company’s licensed technician based on property assessment and professional judgment.

Services DO NOT include:

  • Removal of dead animals from inside structures, unless caught by our traps
  • Structural repairs, exclusion work, or property modifications (available as additional services)
  • Treatment of areas inaccessible or deemed unsafe by Company personnel
  • Control of wildlife species other than rodents (rats and mice)

3. Client Responsibilities and Acknowledgments

The Client acknowledges and agrees to the following:

A. Property Access

Client shall provide unobstructed access to the Property during scheduled service visits. If access is denied or unavailable, Client will still be responsible for the full service fee.

B. Notification Requirements

Client agrees to immediately notify Company of:

  • Any children, pets, or livestock that frequent the treatment areas
  • Any sick or dead rodents found on the Property
  • Any concerns about bait station security or tampering
  • Changes in property conditions that may affect service delivery

C. Pet and Child Safety

Client acknowledges that rodenticides are toxic substances and agrees to:

  • Keep children and pets away from bait stations at all times
  • Not tamper with, move, or open bait stations
  • Supervise pets in areas where bait stations are present
  • Immediately contact Company and seek veterinary or medical attention if accidental exposure occurs

D. Realistic Expectations

Client understands that:

  • Rodent control is an ongoing process requiring continuous monitoring and treatment
  • Complete elimination of all rodents cannot be guaranteed due to factors beyond Company’s control
  • New rodent activity may occur despite proper service due to environmental conditions, neighboring properties, and rodent breeding patterns
  • Results depend on property conditions, sanitation, structural integrity, and environmental factors outside Company’s control
  • Multiple service visits may be required to achieve desired results

4. Limitations of Liability

A. No Guarantee of Results

While Company will use commercially reasonable efforts to reduce rodent populations, Company makes NO WARRANTY OR GUARANTEE regarding the elimination of all rodents or prevention of future infestations. Rodent populations are influenced by numerous environmental and structural factors beyond Company’s control.

B. Liability Cap

To the maximum extent permitted by law, Company’s total liability for any and all claims arising from or related to these Services, whether based in contract, tort, strict liability, or otherwise, shall not exceed the total amount paid by Client for Services in the twelve (12) months preceding the incident giving rise to liability, or $1,000, whichever is less.

C. Exclusion of Damages

Company shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, business interruption, property damage (except as directly caused by Company’s gross negligence), personal injury (except as directly caused by Company’s negligence), or damage caused by rodents, regardless of whether Company has been advised of the possibility of such damages.

D. Third-Party Liability

Company is not liable for injury or damage to third parties, including but not limited to neighbors, visitors, contractors, or trespassers, unless directly caused by Company’s gross negligence or willful misconduct.

E. Secondary Poisoning

Client acknowledges that non-target animals (including pets, wildlife, and birds of prey) may be harmed through secondary poisoning if they consume poisoned rodents. Company is not liable for secondary poisoning of non-target animals unless caused by Company’s failure to follow applicable regulations or gross negligence in product application.

F. Property Damage

Company is not liable for pre-existing property damage, damage caused by rodents (including gnawing, nesting, contamination, or disease transmission), or damage resulting from rodent control methods that are performed in accordance with industry standards and applicable regulations.

5. Indemnification

Client agrees to indemnify, defend, and hold harmless Company, its officers, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Client’s failure to follow Company’s instructions or recommendations
  • Client’s tampering with or moving bait stations
  • Client’s failure to secure Property or supervise children and pets
  • Access to Property by unauthorized persons
  • Pre-existing conditions or infestations on the Property
  • Client’s failure to maintain sanitary conditions or make recommended structural repairs
  • Any misrepresentation by Client regarding Property conditions

6. Insurance and Licensing

Company maintains general liability insurance. Proof of insurance available upon request.

7. Regulatory Compliance

All rodenticides used are EPA-registered products applied according to label directions and in compliance with federal, state, and local regulations. Material Safety Data Sheets (MSDS) available upon request.

8. Termination

Either party may terminate this agreement with thirty (30) days written notice. Client remains responsible for payment of all services rendered prior to termination date. No refunds will be provided for prepaid services unless required by law.

If Company terminates due to Client’s breach, unsafe conditions, or abusive behavior toward Company personnel, Client shall pay all fees due plus any collection costs and reasonable attorneys’ fees.

9. Dispute Resolution

Any dispute arising from this Agreement shall first be attempted to be resolved through good faith negotiation. If negotiation fails, the parties agree to mediation before pursuing litigation. This Agreement shall be governed by the laws of South Carolina, and venue for any legal proceedings shall be in the USA.

10. Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

11. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements. No modification shall be valid unless in writing and signed by both parties.

12. Acknowledgment and Acceptance

By signing the service agreement, Client acknowledges that:

  • Client has read and understands all terms and conditions of this Agreement
  • Client accepts all limitations of liability and exclusions stated herein
  • Client understands the potential hazards of rodenticides and will take appropriate safety precautions
  • Client understands that rodent control cannot be guaranteed and is an ongoing process
  • Client authorizes Company to provide Services as described
